NGT orders Forest Officer to file Status Report in Dera Mandi case

The Coram of National Green Tribunal consisting of Justice Adarsh Kumar Goel, Chairperson along with Justice WP Wangdi, Dr. Nagin Nanda and Mr. Siddhanta Das heard the execution application in a matter of illegal construction/non-forest activity in the forest area of Dera Mandi and Jaunapur for the restoration of the said area in Delhi.

The applicant mentioned in the original application about the areas which were getting encroached by the people. The court had initially directed the patwari to inspect and place a report before the bench on the concern being raised in the application.

Following the reports placed by the conservator and the patwari, the bench ordered the Delhi Government along with the caretaker of the forest to take steps and remove the illegal encroachment and other illegal activity on the premise.

The Court while hearing the execution application of the applicant asked the respondents about the progress on the removal of the encroachment. The Respondent submitted that the work of demolition has not been carried due to the upcoming Delhi Assembly Election and further submitted that there is no encroachment on the forest land as such. On the contrary, the Petitioner alleged that Jhuggi Jhopadi has not been demolished.

The Respondent submitted in the response that they have carried a few demolitions in December. However, the activity of demolition has stopped due to the election. The Court after hearing the parties placed the matter at the end of the February, 2020 for the status report to be filed by the Respondent.
