NGT imposes penalty on UPPCB, Fatehpur DM for their absence in illegal mining case

The National Green Tribunal imposed a cost of Rs 10,000 on the Member Secretary, UPPCB and District Magistrate, Fatehpur each, since no one is present on behalf of them to assist the Tribunal.

The Principal Bench of Justice Prakash Shrivastava, Justice Arun Kumar Tyagi and Dr A. Senthil Vel considered the issue of illegal mining and destruction of trees, plants and hills on account of such illegal mining, near Aung Police Station area, Fatehpur District, UP.

By order dated 08.05.2024, respondents were impleaded and notice was issued to them.   

The CPCB has filed the reply disclosing that permission for mining the ordinary soil was given to one who had carried out the mining of 6732 m3 as against 3200 m3 ordinary soil thus violating the mining permission in terms of quantity of mined soil and doing excessive mining.   

Though, a report has been filed by UPPCB but Counsel of UPPCB is not presented before the Tribunal. 

The report of UPPCB reveals that the penalty of Rs 50,000 has been imposed for violating the mining lease. The report does not reflect that any EC has been imposed by the UPPCB for causing damage to the environment. 

“Though the Member Secretary, UPPCB and District Magistrate, Fatehpur have filed the response but no one is present on their behalf to assist the Tribunal, hence, we impose a cost of  Rs 10,000 each on both of them, to be deposited with the NGT Bar Association within two weeks,” the Tribunal directed and listed the matter on 03.12.2024.
