Allahabad HC directs Noida land scam inquiry committee to probe, submit report in 2 months

The Allahabad High Court has directed the inquiry committee constituted by the order of the government to complete the investigation in two months and submit its report to the court regarding the land scam worth crores in Gautam Buddha Nagar, Noida.

The Division Bench of Justice Sunita Agarwal and Justice Sadhna Rani Thakur passed this order while hearing a PIL filed by Sachch Sewa Samiti.

By means of the Public Interest Litigation, the petitioner is raising the grievance of siphoning of government money in the name of compensation to some persons for the land which was actually Gaon Sabha land.

The allegation is that the award has been passed by the competent authority in collusion with those persons for providing the compensation of the Gaon Sabha land in the name of acquisition of the land in question.

The Court noted,

On the order dated 28.4.2022 passed by the Court, A.K Goel, Additional Chief Standing Counsel, appearing for the State provides an order dated 30.5.2022 of the Chief Secretary, Government of UP whereby a three member committee has been constituted to make inquiry into the issues raised herein. The said inquiry committee has been constituted on the recommendation made by the District Magistrate dated 16.3.2021.

It is submitted by the Additional Chief Standing Counsel appearing for the State that since this is an exhaustive inquiry which would require involvement of many departments of the State, two months time is needed to conclude the same.

“The report of the inquiry committee shall be brought before this Court by the next date fixed along with an affidavit of a competent gazetted officer from the office of the Secretariat of the State Government. However, soon after receipt of the report of the inquiry committee, the appropriate action is to be taken against the erring officials and all corrective measures be also initiated,” the order reads.

The Court has fixed the next hearing of the petition on September 19, 2022.
