The Patna High Court dismissed a Public Interest Litigation (PIL) filed seeking directions to the concerned respondents to conduct physical enquiry of Yojna/Schemes of the Gram Panchayat Raj Gola Pakariya during the financial year 2011-2022.
It is the submission of the petitioner that many schemes were allotted for the development of the said Gram Panchayat, but the Mukhiya had misappropriated the entire money without carrying out any work.
The Division Bench of Chief Justice K. Vinod Chandran and Justice Partha Sarthy observed that it is the financial irregularities of the Government fund that is sought to be enquired into.
The petitioner admits that he was a candidate for the election of the Mukhiya of the Gram Panchayat, but however, he failed. The petitioner also seeks for an enquiry against the Private Respondents, who are husband and wife and who were the Mukhiya of the Gram Panchayat between various periods, respectively between 2011-2016 and 2016-21.
The Bench find absolutely no bonafides in the application and the public interest litigation which makes bland allegation against two persons and the Court dismissed the same .
