The Patna High Court dismissed a Public Interest Litigation (PIL) filed seeking shifting of the location of the proposal for construction of a Court complex from Malpur Village.
It is the contention of the petitioner that there is no proper connectivity to the said Village and there will be a lot of inconveniences arising for the work of the Court and the public.
The Bench noted noticed that there is a procedure in place before a location is identified for building court complex and it does not lie in the mouth of individuals to seek for shifting of the location. The District Magistrate along with the District Judge identifies the location and gets the approval of the High Court before the construction of a Court complex is commenced.
The Division Bench of Chief Justice K. Vinod Chandran and Justice Partha Sarthy find no reason to entertain the petition.
Further the Court noted that there was none appearing for the petitioner when the matter was called in the morning and even later when it was called for hearing after being kept aside.
