The Patna High Court has dismissed a petition filed seeking to quash an e-tender notice and issue a fresh tender.
The petitioner’s counsel sought withdrawal, citing a supplementary affidavit.
However, the respondents’ senior counsel objected, highlighting the petitioner’s failure to disclose a similar, previously dismissed petition of 2024.
The bench of Chief Justice K. Vinod Chandran and Justice Partha Sarthy refused withdrawal, deeming it an abuse of process. It rejected the petition, imposing Rs 10,000 costs on the petitioner, payable to the Bihar State Legal Services Authority within two weeks.
Petitioner liable for recovery charges if payment was delayed, the Court ordered.
