P&H HC Fines Petitioner Who Sought To Put On Hold EWS Quota In Haryana MD/MS Courses

The High Court of Punjab and Haryana imposed a cost of Rs 50,000 on petitioner who had filed a plea seeking directions to the State Government not to implement the reservation for economically weaker sections (EWS) category for admission in postgraduate MD/MS in Haryana.

The bench comprising Justice Rakesh Kumar Jain and Justice Jaswant Singh was hearing a Review Petition filed by Vikram Pal and others contending that the notification issued by the State of Haryana on April 15, 2020 granting reservation to EWS category which was implemented after the admission process began in November 2019 was not permissible.

The counsel appearing for the State of Haryana submitted that the reservations had already been notified by a notification dated January 29, 2020 by the State Government prior to the issuance of notification dated April 15 and hence enforced in the distribution of seats.

He further submitted that the EWS seats are over and above the normal allocation of seats in the state quota, therefore filling or non filling of the seats does not in any manner affects the claims of General Category candidates.

The bench however finding no merits in the submissions put forth by the petitioner imposed a fine of Rs 50,000 and directed that the amount be deposited with the registry within a period of 30 days.
