A Special Leave Petition has been filed in the Supreme Court against the Delhi High Court order rejecting the plea seeking relief of Risk and Hard Duty Allowance as per the provisions of the 7th Pay Commission to the Front Line Health Care Workers and withdrawal of the health workers above the age of 55 years from the front line jobs as per WHO guidelines.
The petition has been filed by Advocate SK Rout challenging the High Court order which dismissed the plea of the petitioner stating that “the 7th Central Pay Commission Report does not specifically recommend payment of Hazard or Risk pay to health workers deployed on COVID 19 duty.”
The High Court also pointed out that the petitioner had not mentioned the grievance of any health worker with regard to non payment of salaries and the Court cannot grant relief only on the basis of what is published in the newspapers.
The High Court had observed that the petitioner has not sought relief either from the State or the Central Government before approaching the High Court. The petitioner has submitted that the Resident’s Doctor’s Association had already made a representation before the Ministry of Health on March 6.
The petitioner has alleged that the High Court has passed the order “with a very mechanical and hyper technical approach.”
