Plea moved before Orissa High Court by lawyer Biswajit Das seeking directions to expunge remarks made against him

A plea has been moved before the Orissa High Court by an advocate seeking direction to expunge the adverse remarks made against him in an order while stating that he took up the case pro bono and the said remark left him with scar. 

The application has been by Advocate Biswajit Das filed stating that the courts are the only signing light in the democratic discourse of this country where a last man standing in the mile can still hope to secure justice against all odds even against the might of the state only because the Courts in India are vigilant and redressal oriented. 

Earlier, in its order dated 22.06.2021, the Bench, led by Justice Biswanath Rath, noted, “This Court disapproves the manner of conducting the case by the Petitioner and declines to hear such Counsel.”

The petition was filed by a student seeking admission into B.Com course at Ravenshaw University for the academic session 2020-21. The plea further sought direction to the University to accept her documents and allow her to take admission in the varsity.

Later, when the matter reached to the bench of the Chief Justice S. Muralidhar. He dismissed the petition on 25.06.2021, observing, “I am, therefore, not persuaded that the University has acted arbitrarily in declining the Petitioner’s representation to be admitted to the B.Com course at a belated stage and to be allowed to take the examination for the first semester with the Petitioner not attending a single class and not satisfying the mandatory requirements.”

However, the present IA which is filed in that matter submits, “this application will not be complete and that the petitioner will be failing in her duty towards this Hon’ble Court and gratitude that she owes towards her counsel Sh. Biswajit Das. If petitioner doesn’t inform this Hon’ble Court about Sh Biswajit Das selfless, sincere, tireless and cost-shouldering contribution in converting Petitioner’s incapacity to access justice and help her knock the door of this Hon’ble Court at appropriate time without any delay.”

The plea contended, “the unmindful of the content/dictation of the order dated 22.06.2021, since petitioner suffered technical glitches at the end at about 4 PM and could not hear the proceedings, Sh. Biswajit Das waited till about 4:15 PM. Only when he was informed by the Opp. Counsels well as the Court Master that the case has been released from the bench.”
