Promotion For The Vacancies Existing Should Not Be Permitted To Remain Hanging: Delhi HC

The Delhi High Court has said that the matter of promotion for the vacancies existing should not be permitted to remain hanging and ought to be dealt with at the earliest while hearing a petition relating to promotion in Central Police Reserve Force (CRPF).

A division bench of Justices Rajiv Sahai Endlaw & Asha Menon was hearing matter of “Sunit Varshney & Others Vs Union of India & Ors,” seeking direction for promotion to the post of Deputy Inspector General & to the rank of Commandant.

The Court directed respondents to get ready with all the facts and figures so that matters can be considered. The matter would now be heard on June 22, 2020.

A petition was filed by eight persons seeking mandamus to the Central Reserve Police Force (CRPF) to convene a Departmental Promotion Committee (DPC) for promotion to the rank of Deputy Inspector General from the rank of Commandant and to the rank of Commandant from the rank of Second in Command, against 19 vacancies already existing and/or coming up in the year 2020 & to consider the petitioners against the said vacancies, for promotion to the rank of Commandant and if the DPC finds the petitioners fit, then to promote them to the rank of Commandant with all consequential benefits, with retrospective effect from the date when the vacancies accrued. 

The petitioners relied on the orders passed on May 29, 2020 in WPC 3275/2020 in case titled as “Satpal Rawat & Ors Vs Union of India & Ors,” which was disposed of on the very first date by directing the respondents to consider the eligibility of the petitioners therein for the post for which the DPC was sought and to, if found the petitioners therein eligible, conduct the DPC and carry out consequential acts. 

The Court on the previous date had issued notice and noted in its order, “it appears that the present petition can be similarly disposed of, directing the respondents to, within the specified time, consider the eligibility of the petitioners herein for participation in the DPC and if found eligible, hold the DPC”.
