Jammu and Kashmir High Court disposes of PIL against proposed garbage yard

The Jammu and Kashmir High Court disposed of a Public Interest Litigation (PIL) seeking appropriate directions so that solid waste/garbage in the Villages of Parigam Wanpora and Tumchi Nowpora of District Pulwama may not be dumped at the proposed site and the Integrated Solid Waste Management Strategy, 2017 be implemented so as to establish the solid waste treatment plant.

The PIL has been filed by the inhabitants of the above villages.

It is contended that the site of the proposed waste/garbage dumping is already reserved for the construction of a school building, primary health centre etc., and cannot be used as such.

The petitioner in this connection has submitted a representation to the Director Urban Local Bodies, Srinagar Kashmir.

The above grievance of the petitioner whether the proposed dumping site has been reserved for any other purpose or that it is not suitable for such a purpose are issues which can be appropriately dealt with by the Deputy Commissioner, Pulwama, observed the Division of Chief Justice Pankaj Mithal and Justice Wasim Sadiq Nargal.

Accordingly, the Bench disposed of the petition with liberty to the petitioner to file a comprehensive representation raising all his grievances in connection with the proposed solid waste/garbage site to be established in village Parigam, District Pulwama before the Deputy Commissioner Pulwama and for the establishment of the solid waste treatment plant in accordance with the integrated solid waste management strategy 2017.

“In the event, any such representation is filed within a period of two week’s from today, the Deputy Commissioner shall accord consideration to the same in accordance with law and pass suitable order after due consideration of the government policy in this regard and verification of the entire facts as expeditiously as possible preferably within a period of three months,” the order reads.
