Punjab and Haryana HC dismisses PIL for recovery of commutation amount for retired HC judges

The High Court of Punjab and Haryana at Chandigarh has dismissed a Public Interest Litigation (PIL) petition filed by H C Arora, citing a service dispute related to the recovery of commutation amount of retired High Court judges.

The court, comprising Chief Justice Sheel Nagu and Justice Anil Kshetarpal, ruled that service disputes cannot be raised through PILs, citing consistent views from the Apex Court in cases such as Dr Duryodhan Sahu vs Jitendra Kumar and Dattaraj Nathuji Thaware vs State of Maharashtra.

The court noted that the petition, though titled as a PIL, essentially dealt with a service dispute.

The Apex Court has previously held that service matters should not be entertained through PILs, as they waste valuable judicial time that could be used for genuine cases.

Although the PIL was dismissed, the court granted liberty to the aggrieved person to raise individual grievances.
