The Punjab and Haryana High Court on Monday disposed of a PIL filed by a petitioner alleging illegalities committed by the respondent authorities in permitting legal transfer and sale of plots in Faridabad and inaction on their part in spite of their own administrator writing a letter dated 02.02.2011 to the authorities bringing the same to light.
Petitioner’s counsel Advocate Rajwant Singh Chahal submitted that in this regard, the petitioner has already filed representations dated 10.03.2021 and 20.04.2021 which are pending before the authorities, and petitioner may be permitted to pursue them finally.
Lokesh Sinhal, Senior Additional Advocate General, appeared for the State of Haryana as well as the Haryana Urban Development Authority (HUDA) submitted that the aforesaid representations filed by the petitioner shall be considered and decided by the respondent authorities as early as possible.
In view of the statement made by the State counsel, the Division Bench of Chief Justice Ravi Shanker Jha and Justice Arun Palli disposed of the PIL with a direction to the respondent authorities to decide the representations dated 10.03.2021 and 20.04.2021 filed by the petitioner expeditiously and in accordance with law.
“However, it is made clear that this Court has not expressed any opinion on the merits of the case and, therefore, the authorities would be at liberty to examine the matter keeping all facts and facets into consideration and thereafter accept or reject the same in accordance with law,”
