Punjab and Haryana High Court disposes of PIL seeking transgender protection cell

The Punjab and Haryana High Court has disposed of a PIL seeking direction to the respondent authorities to set up a Transgender Protection Cell in Punjab, as also to formulate a comprehensive policy on measures and procedure for protection of transgender persons in the State of Punjab.

The PIL has been filed by one Dhananjay Chauhan.

Maninderjit Singh, Counsel for the petitioner, submitted that the petitioner has even moved the respondent authorities in this regard vide various representations as well as e-mails, but to no avail.

To this, Avinit Avasthi, Assistant Advocate General, Punjab, argued that the representations of the petitioner shall be considered and decided expeditiously, in accordance with law.

In view of the aforesaid statement made by the State Counsel, the petition was disposed of by the Division Bench of Chief Justice Ravi Shanker Jha and Justice Arun Palli.

However, it was clarified by the Court that it has not expressed any opinion on the merits of the case and, therefore, the authorities would be at liberty to examine the matter taking all the facts into consideration and thereafter, accept or reject the same, in accordance with law.
