Delhi High Court directs PWD to file affidavit stating it has been awarded tender for relaying road at Prahladpur

A Single Judge Bench of Justice Rekha Palli was hearing a plea to direct PWD, New Delhi to take remedial measure for the water logging under the railway bridge at Prahladpur, Badarpur.

The Delhi High Court on Wednesday directed the Public Works Department (PWD) to file an affidavit stating that PWD has issued and awarded the tender for relaying of the road under the bridge at Prahladpur, Badarpur, also stating that the said work will be started by September 2021.

A Single Judge Bench of Justice Rekha Palli was hearing a plea to direct PWD, New Delhi to take remedial measure for the water logging under the railway bridge at Prahladpur, Badarpur.

Advocate Premsagar Pal, Standing Counsel, PWD informed the court that a tender has been issued and awarded for relaying of the road. The work is expected to start in September 2021 and is expected to be completed by January 2022.

The petition avers that on May 19, 2021, pertaining to heavy rainfall, water had flooded under the railway bridge at Pul Prahladpur, Badarpur, up till 3-4 feet. This caused a heavy traffic jam under the bridge, causing inconvenience to commuters.

On the next day, the movement of vehicle under the bridge was stopped, diverting the traffic towards Mathura Road, National Highway 2, which caused a heavy traffic jam at Mathura Road.

The petition claims that the petitioner has given written complaints to SHO Badarpur, DCP Sarita Vihar, PWD head office, New Delhi and Headquarter, Northern Railway, Baroda House, but to no avail. Furthermore, SHO, ACP and other government officials of Badarpur and Prahladpur often visit the railway bridge, but have ignored the chaotic situation.

According to the petition, the residents of the residential societies near the railway bridge at Pul Prahladpur, Badarpur, have to endure increased pollution levels, as persistent traffic due to waterlogging leads to an increased consumption of fossil fuels, resulting in pollution of the air in the area.

The petition further states, that the petitioners and other residents of adjoining areas have endured this problem for 11 years and this issue of water logging under the railway bridge at Pul Prahladpur, Badarpur has even lead to the death of a minor boy.

The petition has been filed by Advocate Mumtaz Ahmad.

On the Previous date of hearing, the Delhi High Court had issued notice to PWD, Northern Railway and Government of NCT of Delhi.

The next date of hearing is October 8, 2021.
