The Rajasthan High Court has recently disposed of a Public Interest Litigation (PIL) assailing the action of the respondents in constructing the Vikas Path (Road) through agricultural land of village Tinwari.
The PIL has been filed by one Vijay Kumar Goyal.
Kuldeep Mathur, Senior Counsel, submitted that as per the proposal dated 3.10.2019, the Vikas Path (Road) was required to be constructed on land entered as ‘Abadi’ in the revenue record and thus, the respondents have flouted the said order by constructing the road on agricultural land.
To this submission, K.S.Rajpurohit, Additional Advocate General (AAG), submitted that it was consciously decided while issuing the order dated 3.10.2019 that the road shall be constructed in the area which has been inhabited by population and not on land which has been designated to be Abadi land in the revenue record.
This fact is affirmed from the perusal of Clause No.9 (III) of the order dated 3.10.2019. The road in question has already been constructed.
In this view of the matter, the Division Bench of Justice Sandeep Mehta and Justice Vinod Kumar Bharwani opined that there is no merit in the PIL, which is disposed of as such.
