The Rajasthan High Court has observed that it is difficult to interfere in such matters, which are supposed to be considered and decided by the expert body.
The Division Bench of Chief Justice Pankaj Mithal and Justice Rekha Borana passed the order on a PIL seeking direction from the respondents to sanction and allow construction of two-way underpass/ underway at Sareri Chouraha in Gulabpura to Chittorgarh bypass section of National Highway No 79.
“The construction of any underpass or underway at any place on the national highway is a policy matter and this Court finds it difficult to interfere in such matters which are supposed to be considered and decided by the expert body”, the Bench observed .
It has been informed by counsel for the respondents and accepted by counsel for the petitioners that with regard to the construction of two-way underpass/underway in question, the necessary proposal has already been sanctioned and even the additions to it have been sanctioned and constructed.
In view of the above, no cause of action survives in the petition and the same is directed by the Court to be consigned to the record.
