The Rajasthan High Court dismissed a Public Interest Litigation (PIL) filed by the petitioner challenging the validity of the Notification dated 27th July, 2022 issued by the State Government, whereby the Rajasthan Transportation of Merchandise Goods in Stage Carriage and Contract Carriage Buses Scheme, 2022 has been published.
The PIL has been filed by one Muskan Khandelwal.
The Counsel for the respondents made submissions that similar nature petition (Jaipur Purchoon Transport Union, Jaipur & Anr. Vs. State of Rajasthan & Anr.) has been decided on 04th October, 2023 by the Coordinate Bench of the Court, wherein the said scheme has been upheld and therefore, the petition may be dismissed.
The Counsel for the petitioner made submissions seeking to persuade the Court to take a different view.
However, after going through the order passed by the Coordinate Bench of the Court in the case of Jaipur Purchoon Transport Union, Jaipur & Anr. (supra), the Jaipur Division Bench of Justice Arun Bhansali and Justice Ashutosh Kumar was not inclined to take a view different than what has been taken in the said judgment by the Coordinate Bench of the Court.
