The Rajasthan High Court imposed a Cost of Rs 25,000 on the petitioner and dismissed a Public Interest Litigation (PIL) while observing that the petition is filed seeking relief for which already a petition was earlier filed by the present petitioner.
The Division Bench of the High Court vide order dated 29.11.2022 heard and found that the issue may be raised before the National Green Tribunal. However, the petitioner no. 1 has filed this second round of petition this time with two other co-petitioners claiming the same relief adding new grounds, the Court noted.
The Division Bench of Chief Justice Manindra Mohan Shrivastava and Justice Kuldeep Mathur find that the petitioner no. 1 having already appeared as a PIL petitioner before the Court and the order having been passed on 29.11.2022, has again filed this PIL with new co-petitioners.
The Court finds that the process of this Court is being abused by the petitioners under the garb of public interest litigation and by repeating the petitions one after the other by ignoring the earlier Division Bench order.
“Accordingly, this petition is dismissed with a cost of Rs 25,000 payable in the Registry of this Court within one month’, the order reads.
