The Rajasthan High Court recently (January 19), disposed of a Public Interest Litigation PIL , filed regarding the encroachments on the land of school in the Village Mayakoriya, Tehsil Phalodi.
The PIL has been filed by one Kheru Nisha.
The respondents have filed a reply wherein a spot inspection report (Mauka report) states that the land was demarcated/measured and encroachments existing thereupon were removed and the possession was handed over to the school administration.
However, Rajesh Panwar Counsel for the Petitioner submitted that as there is no fencing on the land, the possibility of fresh encroachments always lurks.
In view of the above submissions, Sunil Beniwal , Additional Advocate General agreed that direction may be given to erect a fence/ boundary wall on the land in question.
Accordingly, the Division Bench of Justice Sandeep Mehta and Justice Vinod Kumar Bharwani hereby directed that the respondents shall erect a boundary wall on the land of the school (referred to supra) within a period of six months .
