Rajasthan High Court disposes of PIL on air pollution due to limestone mining units in Pali district

The counsel for the Rajasthan Pollution Control Board stated that the show cause notices for rectification or penal action have been issued against some of these industries.

The Rajasthan High Court has recently disposed of a PIL on the air pollution caused by limestone mining industries in and around village Boyal, tehsil Sojat city, district Pali.

The PIL has been filed by one Madhu Lal.

On November 12, 2021, a Division Bench of the High Court had required the Rajasthan Pollution Control Board to give a status report after carrying out a fact finding enquiry. The Rajasthan Pollution Control Board has submitted its report dated 15.11.2011. Along with the report, the list of industries, where the pollution control measures are not operational and as a result the industries contribute in causing pollution, has been filed.

The counsel for the Rajasthan Pollution Control Board stated that the show cause notices for rectification or penal action have been issued against some of these industries. Wherever it is found necessary, such further notices will be issued against the erring industries.

While considering the PIL, the Division Bench of Chief Justice Akil Kureshi and Justice Rekha Borana held that let the Rajasthan State Pollution Control Board take further measures in accordance with law in relation to the initial facts gathered pursuant to the enquiry carried out under the order of the Court.

“We expect that the Pollution Control Board would ensure that the industries concerned comply with the pollution safety norms and take such measures as found necessary in accordance with law to have the same complied with. The petition is disposed of accordingly,”
