The Rajasthan High Court disposed of a Public Interest Litigation (PIL) filed for the finalization of the process of amalgamation of Farmer Service Society with the Village Service Cooperative Society.
The petitioner in the petition himself stated that he is a Member of Farmer Service Society and had taken a loan of Rs.18,000/- from the said Society.
It, therefore, appears to the Court that the petitioner has preferred this petition in his individual capacity rather than in public interest. A private cause of such a nature involving the petitioner cannot be permitted to be raised through Public Interest Litigation , observed the High Court.
In view of the above, the Division Bench of Chief Justice Pankaj Mithal and Justice Rekha Borana do not feel inclined to exercise their discretionary jurisdiction in the matter.
The Court directed that however, as there is no dispute that the process of amalgamation of the Society had started way back on 16.09.2018 and under Section 13 of the Rajasthan Cooperative Societies Act, 2001, the process has to be completed as far as possible within a period of three months, the Bench expected that the respondents would ensure that the amalgamation process is completed most expeditiously.
