The Rajasthan High Court disposed of a Public Interest Litigation (PIL) filed alleging that the land recorded as Charagah is being used for the purpose of construction of interlocking road.
The counsel for the petitioner submit that though the petitioner has made representations to various authorities/respondents- Collector, Alwar as also to Chief Executive Officer, Zila Parishad, Alwar, Tehsildar, Tehsil Jamva Ramgarh, District Jaipur as also Assistant Engineer, Panchayat Samiti, Behror, District Alwar but till date no inquiry has been made.
Rajesh Maharshi, AAG , appearing for State would submit that this petition may be disposed of with a direction to the Tehsildar to verify the identity of the land at the spot with reference to revenue record by appropriate measurement.
In view of the statement so made, the Division Bench of Justice Manindra Mohan Shrivastava and Justice Praveer Bhatnagar was not inclined to keep this petition pending.
Tehsildar, Tehsil Jamva Ramgarh, District Jaipur shall undertake a spot inspection and identify the land which is alleged to be Charagah land and being used for construction of interlocking road. Depending upon the spot inspection report, if it is found that it is a land of Charagah, the respondent authority shall issue necessary directions in this regard , the Bench directed.
