Reply in a week on supplementary exam system, Delhi HC tells DU

New Delhi: The Delhi High Court has asked the Delhi University to come clear on its stand on the supplementary examination system within a week on a plea filed by final year law students of the university’s law faculty.

A single judge bench of Justice Pratibha M. Singh has said,

“last opportunity, is granted for filing of further affidavit by DU, subject to payment of Rs. 5,000/- as costs. Let the affidavit be filed within one week.”

“No further opportunity shall be granted,” said the Court.

The petition has been filed by final year law students of the university’s law faculty, seeking permission to give their supplementary examinations for those exams which they have not passed in the first to fourth semesters.

The petitioners have approached the High Court against the new scheme introduced by the University in which a final year student who has not cleared any examination from the first to fourth semesters may appear for those examinations at the “regular examination” held at the end of each term.

On August 22 the court had directed DU to file a short counter-affidavit. The court had directed DU to file a further affidavit detailing the following:

(i)                 Was there a system of holding supplementary examinations for odd semesters for final semester students along with the examination for the final semester and if so when was the same discontinued?

(ii)               Whether DU requires any approval from the Bar Council of India for holding the Supplementary examinations and if so, whether it has received the same for the new system?

Advocate Amit Kumar Sharma, appearing for the students today, submitted that the University has not filed a reply, despite the direction from the Court to file a detailed reply within 4 weeks.

The bench has directed the University to file a fresh reply in the matter.

Amit Kumar further submitted that he is challenging the legality of the impugned notification of DU of August 22, 2017 and informed the court that DU has also not replied to an RTI application filed by them.
