The Allahabad High Court has directed that the personnel posted in the Railway Protection Special Force be transferred to the Railway Police Force zone of their choice.
A single-judge bench of Justice Manju Rani Chauhan passed this order while hearing a petition filed by Uma Kant And 234 Others.
By means of the writ petition, the petitioner has questioned the impugned Revised Directive-32, dated 28th December, 2017 issued by respondents.
Further, the petitioner has prayed for a direction upon the respondent authorities to consider the grievance of the petitioner with regard to their transfer from Railway Protection Special Force to the desired/opted Zonal Railways in Railway Protection Force in pursuance of the existing directives at the time of entering in their services.
Counsel for the petitioners and the counsel for the respondents submit that the controversy involved in the writ petition is more or less identical to those of Writ-A No 37638 of 2017 (Harish Chandra & 62 Others Vs Union of India & 5 Others), which has been decided by a Coordinate Bench of the Court order dated 2nd August, 2019.
“In view of the aforesaid submissions, for the reasons recorded in the judgment and order dated 2nd August, 2019 passed in the aforesaid writ petition, this petition is also allowed with the same terms and conditions”
-the Court observed.
“Accordingly, the Revised Directive-32, dated 28th December, 2017 issued by respondent no 2 is set aside and quashed. It is provided that the petitioner’s transfer/placement shall be considered strictly under the concerned Standing Order as per their choice (OMR) and seniority, provided vacancies of Constables RPF are available in the preferred Zone, as on date,” the Court ordered.
