The Madhya Pradesh High Court while observing that the Petitioner has come to the Court seeking for a writ of habeas corpus whereas the allegation against him is that he has murdered the corpus imposed a Cost of Rs.25,000/- on the Petitioner.
The Division Bench of Chief Justice Ravi Malimath and Justice Vishal Mishra dismissed a petition filed seeking for a writ of habeas corpus to produce the petitioner’s daughter. Complaint was also filed by the petitioner on the ground that his daughter has gone missing.
Notices were issued. A reply has been filed by the State wherein they have stated that a complaint has been lodged by the mother of the child that her husband has committed the murder of the child. Hence, accordingly an FIR was lodged with regard to the same. Her statement has also been recorded.
In view of the plea of the petitioner seeking for bail it is quite evident that in order to hide the offence that he has committed, the instant petition has been filed , the Court observed.
From the material on record the Court noted that this is nothing but an abuse of the process of the court. “He has come to the Court seeking for a writ of habeas corpus whereas the allegation against him is that he has murdered the corpus.”
In these circumstances, the petition being devoid of merit, is dismissed. Cost of Rs.25,000/- is imposed on the petitioner,
