SC grants bail to 77-yr-old after DNA reports prove that he is not the father of the child of rape victim

New Delhi: The Supreme Court granted bail to a 77-year-old army pensioner, accused of raping a girl, following DNA reports that proved that he was not the father of the rape victim’s child.

The bench, presided by Justice Sanjay Kishan Kaul, was hearing the bail plea filed by Jayant Chatterjee of West Bengal, who had been arrested and charge-sheeted by West Bengal Police on the testimony of a 14-year-old girl that he was the father of her child and that she became pregnant because he continuously sexually exploited her taking advantage of his status as the landlord.

The bench had earlier directed the state to conduct a DNA test of the accused, pursuant to which the state filed an affidavit on August 21, including the DNA report which did not show that the accused was the father of the child born.

The bench thus observed: “In view of the aforesaid, we have no hesitation in saying that the appellant should be enlarged on bail on the terms and conditions to the satisfaction of the trial court.”

The counsel appearing for Chatterjee then submitted that it is out of a landlord-tenant dispute that a false case has been filed and that he should be given appropriate compensation.

The bench granted him the liberty to take the necessary steps to claim compensation in accordance with the law.
