SC Seeks Reply From Centre In Plea Seeking Unhindered Movement Of Advocates From Nearby States

The Supreme Court of India on Tuesday has directed the Central Government to file a reply in a Public Interest Litigation seeking unhindered movement of Advocates from adjoining States.

Adv Mukul Talwar appearing for the petitioners has said that“we are focusing on Central NCR where the industries are located”.

Advocate Garima Prashad has stated before the court that “Noida has 10 lakh people. Delhi has 2 crores. Noida has 209 positive cases. Delhi has over 11k positive. Hence, we are being cautious”. She further added that “UP also said that they are being facilitated in coordination with NCT”.

The Supreme Court bench comprised of Justice Ashok Bhushan, Justice Sanjay Kishan Kaul & Justice M.R. Shah, while hearing the petition said that ‘We need to know the stand of UOI”.

On an earlier occasion, the Delhi High Court had asked the Uttar Pradesh Government to allow entry of Advocates freely in between Delhi and UP on the same basis as Haryana Government is allowing by issuance of weekly passes.

The Court said, “We find that movement of advocates between the said two States and the NCT of Delhi, in such like cases – where the advocates are residing in one or the other State, and working in the NCT of Delhi, should be permitted within reasonable limits, since legal services are essential services.”

The Delhi High Court had directed the State of UP to adopt same method for issuance of e-passes on weekly basis, as has been evolved by the State of Haryana. The State of UP shall consider these aspects before the next date said the Court and listed the matter for hearing on May 20.
