High Court seeks status report by Delhi government, police on sexual assault of three-year-old girl

The High Court of Delhi has directed the Government of National Capital Territory of Delhi (GNCTD) and the Delhi Police to submit a status report over the alleged sexual assault of a three-year-old girl by a cleaner in a South Delhi school.

Taking suo motu cognisance of a news report highlighting the incident, the Division Bench of Chief Justice Satish Chandra Sharma and Justice Saurabh Banerjee on Tuesday directed the Delhi Police as well as the Delhi Education Department to file a status report in respect of action taken in the matter within two weeks.

The High Court listed the matter for further hearing on September 1, 2023.

The Bench told Advocate Santosh Tripathi, appearing for the Delhi government, to ensure that the names of the girl child as well as her parents were masked in the status report.

The Counsel was further directed to undertake all necessary measures to protect the identity and right to privacy of the girl child.

The High Court told the Delhi government to ensure that the media acted in compliance with the statutory provisions as contained in Section 23 of the Protection of Children from Sexual Offences Act (POCSO Act), 2012.

The development ensued after Justice Subramonium Prasad brought to the notice of the court a news item published in the Times of India last week.

As per the news report, the Delhi Police has arrested 33-year-old Arjun Kumar for allegedly sexually assaulting a three-year-old girl at a school in Delhi’s Hauz Khas.

It further highlighted that a case under Sections 376 (punishment for rape) and 377 (unnatural offences) of the Indian Penal Code (IPC) and Section 6 of the Protection of Children from Sexual Offences Act (POCSO) have been filed against Kumar.
