Allahabad High Court dismisses petition seeking appointment of Shiksha Mitra as assistant teacher

The Allahabad High Court has dismissed the petition seeking appointment of Shiksha Mitra as assistant teacher.

A Single Bench of Justice Kshitij Shailendra passed this order while hearing a petition filed by Deep Narayan Singh.

The petitioner submitted that he has been declared by the Court as unfit to be appointed as an Assistant Teacher.

He also submitted that the said judgment of Full Bench has been upheld by the Supreme Court.

The submission of the petitioner is that he was issued a notice dated 20.04.2024 by the District Magistrate/ District Election Officer calling upon him to perform some election duty and, in the said notice, the description of the petitioner was shown as Assistant Teacher, Composite Vidyalaya, Deoria.

He said that if the Government thinks him fit to work as Presiding Officer in an election, he should also be treated as fit to work as Assistant Teacher and, therefore, the adjudication made by this Court as regards incompetence of Shiksha Mitra to be appointed as Assistant Teacher was erroneous.

Merely at the strength of the said notice, the petition has been filed with a prayer that the respondents be directed to treat the petitioner as Assistant Teacher and to pay his salary with effect from the year 2015.

“Having heard the petitioner in person, the Court finds that merely because the petitioner has been described as Assistant Teacher in the notice dated 20.04.2024, the same would not ipso facto make him qualified to be appointed as Assistant Teacher so as to obtain a designation as such or to get salary, particularly when full Bench of the Court as well as Apex Court, according to the petitioner himself, have held the persons like the petitioner, working as Shiksha Mitra, ineligible for being appointed as Assistant Teacher. The petitioner indirectly expects the Court to pass an order which may run contrary to the decisions of the Full Bench and the Apex Court. This is wholly impermissible”, the Court observed while dismissing the petition.
