Stray cattle endangering motorists: Delhi HC issues notice in plea by advocate

The Delhi High Court on Tuesday issued notice in a plea seeking the issuance of appropriate orders against the respondents to remove stray animals from the road causing inconvenience to the common public.

The single-judge bench of Justice V. Kameswar Rao issued notice on the petition by Satish Sharma under Articles 226 and 227 of the Constitution.

The petitioner is a resident of Meethapur village in New Delhi and is an advocate by profession and commutes to Saket from Meethapur for work.

The petitioner said that being a citizen of India, he has a legal right against infringement of his fundamental rights under Articles 226 and 227.

On June 21, 2021, the petitioner said he narrowly escaped an accident due to the flock of cows and bulls on the road near Air Force bus stop. Other commuters also applied sudden brake to prevent the mishap. The petitioner then filed a complaint about the incident to the authorities concerned and requested them to remove stray animals blocking the roads but no action was taken.

Again on December 15, 2021, on the same route, the petitioner sustained injuries when a quarrel among stray cows and bulls led to them slamming into his two-wheeler. The petitioner sustained injuries on his palm, wrist, knees and ankle and took treatment for the same after he reached home. He again complained to the respondents but no action has been taken by the authorities.

The petitioner contended that such acts of the respondents are illegal and wrong in the eyes of the law and they are duty bound to take appropriate legal action to prevent illegal gathering of stray cattle on the road. The respondents failed to perform their duty even after getting complaints, the plea said.

The petitioner prayed to the High Court to issue appropriate orders to remove stray animals from the road and enforce a regular check to stop the gathering of cattle on the road to prevent accidents.
