Unnao rape case: Delhi High Court modifies bail conditions; Kuldeep Singh Sengar to remain out from January 27 to 30, February 6 to 10

The High Court of Delhi on Friday modified the conditions set out on interim bail granted to expelled BJP MLA Kuldeep Singh Sengar in the rape case of a 17-yeard-old girl in Unnao district of Uttar Pradesh.

The High Court granted two interim bails to the accused, noting that the interim bail would be from January 27 to 30, while the second would be from February 6 to 10.

On January 25, the High Court had issued notice to the Central Bureau of Investigation (CBI) on a petition filed by Unnao rape survivor, seeking cancellation of interim bail granted to Sengar.

The petition sought cancellation of interim bail granted to Sengar on the grounds that she apprehended threat to her life and that of her family by the expelled BJP MLA.

The High Court had earlier granted interim bail of two weeks to Sengar, in order to attend his daughter’s wedding, scheduled to be held on February 8.

He is currently serving 10 years imprisonment in the case related to custodial death of Unnao rape victim’s father.

Noting that the Division Bench of the High Court had already granted interim bail to the expelled BJP MLA in the rape case of a 17-year-old girl, the Single-Judge Bench of Justice Dinesh Kumar Sharma observed that the conditions placed on the accused were sufficient.

The Division Bench of Justice Mukta Gupta and Justice Poonam A. Bamba, on January 16, had granted interim bail to Sengar from January 27 to February 10.

The petitioner had contended in his plea that pre-wedding events would start from January 18 and being the only male member of the family, he had to make arrangements for the functions.

The High Court had earlier also issued notice to the Central Bureau of Investigation in December last year, seeking verification of the facts stated by Sengar in his bail application.

The former BJP MLA was sentenced to life imprisonment by a Delhi court on December 20, 2019, for raping a 17-year-old girl on June 4, 2017 in Unnao district of Uttar Pradesh. Sengar was also directed to deposit a fine of Rs 25 lakh in the case.

Two charge sheets were filed by the CBI against him.

First was filed on July 11, 2018, accusing the former Bharatiya Janata Party leader of rape. The second charge sheet was filed two days later, accusing Sengar, his brother, three policemen and five other individuals of framing the rape survivor’s father as perpetrator in the case.

The Unnao rape survivor attempted to immolate herself at the residence of Uttar Pradesh Chief Minister Yogi Adityanath in April, 2018. Her father later died in judicial custody.
