The Allahabad High Court has directed the Executive Engineer of UP Awas Evam Vikas Parishad to dispose of the application for compounding against unlawful construction at Prem Garden of Vinayak Nagar in Kanpur within a month.
The Division Bench of Justice Pritinker Diwaker and Justice Ashutosh Srivastava passed this order, while hearing a petition filed by Arti Singh and another.
After receiving the demolition notice dated June 1, 2020, the petitioners have filed an application, seeking compounding the constructions. The said application has not been decided yet, the Court noted.
The Counsel for the petitioners submitted that the purpose of filing the petition would be served, if directions are issued to the Executive Engineer, Awas Evam Vikas Parishad, Kanpur for deciding the said application and till then, the constructions may not be demolished, otherwise, the petitioners would suffer an irreparable loss.

The Counsel appearing for the UP Awas Evam Vikash Parishad has no objection to this proposition.
“Without observing anything on merits of the case, the petition is disposed of expecting the competent authority to decide the pending application of the petitioner in accordance with law as expeditiously as possible preferably within one month.
Till 45 days from today, the construction of petitioners may not be demolished, the Court ordered.
