Allahabad HC seeks reply from UP govt advocate on plea against solid waste plant in Harijan colony

The Allahabad High Court has sought a reply from the state government advocate on a petition against the setting up of a Solid Waste Management Plant in the midst of Harijan Abadi of Jamalpur village of Jaunpur.

The Division Bench of Justice Sunita Agarwal and Justice Vikram D. Chauhan passed this order while hearing a PIL filed by Paras Nath And 4 Others.

The petitioners herein are raising grievance with regard to construction of (Solid Waste Management plant) in Gata no 797M/0.250 hectare, Village Jamalpur Pargana Ghisua which, according to them, is recorded as Harijan Abadi. In support of his submissions, the copy of CH form 41 of the village concerned has been brought on record to the writ petition.

The petition stated that the Nagar Panchayat concerned is creating a waste management plant in the heart of the Harijan Basti which would create serious health hazards for the residents.

However, in order to ascertain the issues being raised herein, the Court directed that the Standing Counsel shall seek instructions from the District Magistrate under whose order dated 15.3.2022, Gata no 797M/0.250 hectare has been resumed and handed over to the Nagar Panchayat concerned for construction of the Solid waste management plant.

“S.K. Srivastava, counsel appearing for respondents, shall also seek instructions to answer the objections of the petitioners that the Solid Waste Management Plant cannot be established in the heart of the Harijan Abadi as it would be a health hazard for the denizens,” the order reads.

The Court has fixed the next hearing of the petition on June 30, 2022.
