Allahabad High Court rejects bail plea of aspirant who used impersonator for exams

The Allahabad High Court has rejected the bail application of Amarjeet Chaurasiya who made someone else sit in the constable recruitment exam in his place.

A Single Bench of Justice Rohit Ranjan Agarwal passed this order while hearing a Criminal Misc Bail Application filed by Amarjeet Chaurasiya.

By means of the application, applicant Amarjeet Chaurasiya, who is involved in Case under Sections 419/420/467/468/471/120B IPC and 3/9 of U.P Public Examination Act, Police Station Chitaipur, District Varanasi, seeks enlargement on bail during the pendency of trial.

The prosecution story, as unfolded, reveals that in the examination conducted by U.P Police Recruitment Board for selection of Constables, one imposter Chandan Kumar Yadav had appeared in the said examination in place of original candidate/ applicant Amarjeet Chaurasia, which was conducted at S.B Shiksha Niketan Intermediate College, Karaundi Sundarpur, BHU Varanasi on 17.02.2024.

During verification of biometric, which was mismatched, it was found that an imposter was appearing in the examination in place of the original candidate/applicant, on the basis of forged admit card and Aadhar Card. The said imposter Chandan Kumar Yadav was apprehended by the school authorities and has been handed over to police on the same day.

It is contended by the counsel for the applicant that the applicant has been falsely implicated in the case.

He further submitted that the applicant has no concern with Chandan Kumar Yadav.

Counsel for the applicant also submitted that the applicant is languishing in jail since 20.03.2024, having no criminal history to his credit, deserves to be released on bail. In case, the applicant is released on bail, he will not misuse the liberty of bail and shall cooperate with trial.

AGA has vehemently opposed the bail application and submitted that during examination for recruiting Constables in U.P Police, which was held on 17.02.2024, that in place of original candidate/applicant, one imposter Chandan Kumar Yadav had appeared in the said examination, on the basis of forged admit card on which the photograph of applicant was pasted.

He further submitted that on mismatch of biometric, imposter Chandan Kumar Yadav has been caught by the school authorities on the spot and handed over to police, who, in his statement, clearly stated that he was appearing in the said examination in place of the applicant.

He also submitted that the bail application filed by the co-accused Chandan Kumar Yadav has already been rejected by the Court on 12.07.2024, as such, bail application of the applicant is also liable to be rejected.

The Court observed that it is a case where an imposter namely Chandan Kumar Yadav had appeared in the examination, conducted by U.P Police Recruitment Board for recruiting Constables in U.P Police, in place of original candidate/applicant and on mismatch of biometric he was apprehended on the spot by the school authorities and in his statement he has clearly stated that he was appearing in the said examination in place of the applicant.

“Moreover, cheating in government exams undermines the principles of meritocracy and equal opportunities, which were essential for fostering social mobility and ensuring fairness in society. It perpetuates inequalities by favoring those, who could afford to pay for fraudulent activities, while disadvantaged those, who rely on their hard work and merit to succeed. The acts of cheating in examinations, thus, must be dealt with a stern hand, as their effects were not limited to an individual but impact society as a whole”, the Court said while rejecting the bail application.
