The Allahabad High Court on Wednesday has directed the District Inspector of Schools (DIOS) and Finance and Accounts Officer, Ballia to clarify on March 3 why the payment of petitioner’s Parmatma outstanding salary was held for five years. The Court also asked the two officials to dispose the teacher’s case by February 26.
This order has been given by Justice Salil Kumar Rai on a petition of Parmatma Nand Singh, who was represented by Advocate Kashinath Singh.
From a perusal of the instructions received by the Standing Counsel, it is apparent that the letter dated May 26, 2015 was written by the Director of Education (Secondary) to the DIOS to verify the alleged arrears of the petitioner’s salary.
In pursuance of the aforesaid letter, the DIOS, Ballia vide his order dated February 6, 2021 directed the Finance & Accounts Officer, Secondary Education, Ballia to verify the arrears of salary accruing in favour of the petitioner as a consequence of pay fixation. It is not clear from the instructions as to what steps were taken between 2015 and 2021.
The fact that the matter regarding the petitioner remained pending in the office of the DIOS, Ballia for 5 years shows the negligence of the DIOS, Ballia, the court said.
“The District Inspector of Schools and the Finance & Accounts Officer in the office of the District Inspector of Schools shall dispose of the matter relating to the petitioner within two weeks from today and in any case, latest by February 26, 2021,” the Court orderered.
The DIOS, Ballia and the Finance & Accounts Officer shall be personally present in the Court and shall file their personal affidavits indicating the reasons for the delay in disposing of the matter of the petitioner.
The next hearing of the Petition will be on March 02, 2021.
