The Allahabad High Court has directed the authorities concerned to include candidates, who have not yet submitted their educational certificates, for counselling in the appointment of allopathic doctors.
A single-judge bench of Justice Ashwani Kumar Mishra passed this order while hearing a petition filed by Dr. Mohini Singh and 3 others. The petition has been entertained on a mention made by the counsel for the petitioner.
The Uttar Pradesh Public Service Commission advertised 75 posts of allopathic officer Grade-II in advertisement no.1/2021-22. The petitioners have applied against the advertisement and have been selected by the Commission. But their names have not been recommended to the State Government for participating in the counselling on the ground that various documents, which were required to be produced by them have so far not been placed before the Commission.
The Court noted, “There appears a communication on record as per which all the petitioners have been given 60 days’ time to furnish original documents before the Commission, which expires on November 5, 2021. The petitioners, however, have rushed to the Court with the allegation that a large number of candidates have already been recommended by Commission for counselling which is scheduled to be held on November 1 and 2, 2021.
It is stated that in the event selections are made, the petitioners would suffer irreparable injury inasmuch as their claim for counselling may have to be overlooked due to lack of availability of requisite posts/vacancies.
The Court found substance in the contention advanced on behalf of the petitioner that once the Commission has allowed time until November 5, 2021 to furnish original documents the respondents cannot be allowed to act in a manner where petitioners’ claim for appointment itself gets defeated.
“In the facts and circumstances, it is provided that the Commission shall provisionally recommend petitioners’ name for counseling scheduled to be held on 1st & 2nd November, 2021, forthwith, and the State shall thereafter provisionally permit them to participate in the counseling. However, petitioners’ candidature shall remain subject to the appropriate satisfaction at the level of the Commission with regard to their educational and other qualifications. It shall be open for the petitioners to furnish their original records as are required before the Commission within the time permitted,” the Court ordered.
The Court has fixed the next hearing of the petition on November 11.
