Allahabad High Court orders promotion, other benefits for retired employees in Uttar Pradesh Prisons department

The Allahabad High Court has ordered to give promotion and other benefits to the retired employees in the Uttar Pradesh Prisons Department.

A Single-Judge Bench of Justice Rohit Ranjan Agarwal passed this order, while hearing a contempt application filed by Ram Kishor Shukla under Section 12 of the Contempt of Courts Act.

The plea sought punishment for Opposite Party for willful disobedience of the judgement and order dated July 14, 2021 passed by the Court in Special Appeal Defective (Ram Kishor Shukla vs State of UP and four others).

It was contended that the Special Appeal filed by the applicant being Special Appeal Defective was allowed by the Division Bench on July 14, 2021, directing the opposite party to give effect to the recommendation dated August 22, 2017.

A copy of the order of Division Bench was sent through registered post on August 5, 2021, but according to the applicant, till date, the order has not been complied with.

“Prima facie, a case has been made out for punishing the opposite party for willful disobedience of the order dated July 14, 2021 passed in the petition”, the Court observed.

However, no notice was issued to the opposite party at this stage. The Court granted the opposite party three months further time to comply with the order dated July 14, 2021 passed by the Court in Special Appeal Defective from the date of production of a self-verified copy of the order.

“The applicant shall supply a duly stamped registered envelope addressed to the opposite party and another self-addressed envelope to the office within one week. The office shall send a copy of the order, along with the self-addressed envelope of the applicant with a copy of contempt application to the opposite party within one week thereafter and keep a record thereof.

“The opposite party shall comply with the directions of the writ court and intimate the applicant the order through the self addressed envelope within a week thereafter.

“In case, the opposite party does not comply with the order, it would be open to the applicant to approach the court again. With the aforesaid observations, this application is finally disposed of at this stage”, the Court ordered.

Pratik Chandra, Counsel for the petitioner, argued that the petitioner had retired in 2014. After that, in departmental promotion, he was made deputy jailer from head jail warder. But till date, he has not got the benefit of it, even after a Division Bench of two Judges of the High Court had ordered the petitioner to be given promotion and other benefits.
