The Uttarakhand High Court issued notice on a Public Interest Litigation (PIL) filed seeking several directions for compliance to the Water (Prevention of Control of Pollution) Act, the Environment (Protection) Act, 1986, and the Rules framed thereunder, in relation to Biomedical Waste Management, Construction and Demolition Waste Management, E-waste (Management), and the Hazardous and other Wastes (Management and Transboundary Movement).
The allegations in the petition are directed against the Nagar Palika Parishad, Mussoorie. However, Nagar Palika Parishad, Mussoorie is not impleaded as a party respondent.
The petitioner makes a prayer that the said Parishad shall be impleaded as a party respondent which is allowed by the High Court.
The division bench of Chief Justice Vipin Sanghi and Justice Alok Kumar Verma directed the respondents to file their responses within three weeks.
“They should deal with the specific allegations made by the petitioner in this petition. In case, there is any merit found in the petitioner’s submissions by the respective respondents, without waiting for any further orders, we expect them to take the requisite and corrective steps., the Bench further directed.
The matter is listed on 05.09.2023 for further hearing.
