You cannot expect students to attend 70% classes when you teach only 40% of study period: Delhi HC to DU

New Delhi: The Delhi High Court today issued notice to the Bar Council of India, Delhi University and Central government in a plea filed a law student who was debarred from examination due to lack of attendance as he was suffering from typhoid and was a suspect of tuberculosis.

A bench of Chief Justice D.N. Patel and Justice Prateek Jalan, while hearing the matter through video conferencing, stated: “You cannot say students have to have 70 per cent minimum attendance, while you teach only 40 per cent of the prescribed study period.”

The petition has been filed by Abhishek Singh a student of DU’s faculty of law through his advocate Kamal Mehta challenging the order of the single judge bench dismissing his plea seeking waiver of shortage of attendance and allowing him to sit for his first semester exams.

The bench today observed that and stated to the university and BCI that to take-care of students such as the petitioner, who has been suffering from illness since 2017, there should be some mechanism instead of creating a wall.

The court has also asked Mehta to inform the court what was the minimum period of study prescribed for the LLB course by DU and whether it is being complied with.
