A bench led by the Chief Justice Dipankar Datta & Justice G.S. Kulkarni has noted that there is no categorical prohibition imposed by the Central Government for the States to undertake a door-to-door vaccination program, for the elderly and disabled citizens.
The case was related to the custodial death of an accused, who was arrested in a case of alleged rape and murder of a 16-year-old school girl in Kotkhai area of Shimla district. The trial in the 2017 case was transferred to Chandigarh on orders of the Supreme Court.
Luthra also referred to the West Bengal State amendment to Section 167 CrPC. He said that West Bengal is only State which allowed production of accused through video audio conference even before the Covid era. Luthra referred to 2(g).
