Supreme Court Suggests Floor Test In Uttarakhand Assembly; Centre To Respond On May 4th

The Supreme Court of India has suggested floor test in the Uttarakhand Assembly while posting the matter for further hearings to May 4.

A division bench of Justices Dipak Misra and Shiv Kirti Singh heard a challenge to the order of the state High Court ordering for floor test and nullifying the Centre Rule in the state. The Centre has challenged the Uttarakhand High Court order came on a petition by displaced chief  minister  Harish Rawat.

The Centre is expected to respond to this suggestion of the Supreme Court tomorrow, May 4 2016.

Just a day before he was to face the confidence vote on the floor of the assembly, Rawat was sacked under Article 356 of the Constitution invoked by the BJP led government at the Centre. It has triggered a major time old controversy of misuse of the constitutional provision.

After nine of Rawat’s MLAs allegedly voted against him when he presented the budget for the state, the Centre said that the budget was wrongly declared as approved, when, in fact, most members had not backed it.

The Uttarakhand High Court has sternly held that the Centre had acted in an “unjustifiable hurry” to dissolve the state assembly putting the state under Governor’s rule. Earlier India’s Top Court has said that till it came to a decision, the Centre must ensure that Uttarakhand remained under President’s Rule. The Congress has cried wolf and stated that without this order of the Apex Court the BJP would have manipulated to form its government in the state.
