Aligarh Muslim University: Constitution Bench to hear plea pertaining to minority status from January 9

The Supreme Court Constitution Bench of will start to hear the plea begin pertaining to the matter of Aligarh Muslim University retaining its minority institution status.

The seven member constitution bench led by CJI DY Chandrachud along with Justice Sanjiv Khanna, Justice Surya Kant, Justice JB Pardiwala, Justice Dipankar Datta, Justice Manoj Misra and Justice KV Vishwanathan will decide if an educational institution created by a parliamentary statute can enjoy Minority Status under Article 30 of the Constitution.

The bench earlier had Justice Sanjay Kishan Kaul, who superannuated on Decemeber 25, 2023.

AMU had reserved 50% seats in postgraduate medical courses for Muslim candidates in the year 2005,by claiming it to be a minority institution.

The Allahabad High Court however set aside by order. A year later, in 2006, the Union government and AMU challenged the High Court’s decision before the Supreme Court. 

In the year 2016, the National Democratic Alliance government, withdrew from the appeal contending that it does not acknowledge the minority status of the University.
