The Supreme Court on Monday deferred its final decision in the matter of CBSE board exam till tomorrow, as several writ petitions questioning the CBSE scheme for evaluation of the marks, was not listed in front of the bench for consideration.
“During the course of arguments, we were informed that a batch of writs has been filed, questioning the decision of the concerned Boards, which haven’t been listed,” observed the Bench of Justice A.M. Khanwilkar and Justice Dinesh Maheshwari.
The bench then adjourned the matter, after making the remark, “It’s appropriate that those petitions are heard tomorrow at 2 pm.”
The Counsels appearing for the state of Assam, Punjab and Tripura informed the Bench that the State board has also cancelled the board exams.
The State of Andhra Pradesh is now the only state government, which has not taken a decision on cancellation of Class 12 exams.
Standing Counsel of Andhra Pradesh, Advocate Mahfooz Nazki, told the Supreme Court that the state government wants to conduct the physical exams as a matter of policy.
The petition was filed by Advocate Mamta Sharma, seeking cancellation of CBSE and ICSE Class 12 board exams, while another plea seeking the cancellation of Class 12 State Boards, HSC, and NIOS physical exams was filed by Child Rights activist Anubha Srivastava and seven others.
Earlier on June 17, the CBSE Class 12 Evaluation Criteria 2021 for result calculation has been submitted to the Supreme Court. In the detailed criteria as shared, marks scored by students in their Classes 10, 11 and 12 would be considered in the ratio of 30, 30 and 40 percent.

On June 1, the Board had cancelled the CBSE class 12 board examination amidst the continuing upsurge in COVID-19 cases across the country. The decision to cancel the CBSE class 12 board examination 2021 came after a high-level meeting chaired by Prime Minister Narendra Modi regarding the class 12 board examination was held on June 1, 2021.
The Apex Court had expressed its satisfaction regarding the Central government’s decision to cancel the class 12 board exam. The court had further directed the CBSE and the CISCE to come up with a well-framed objective criterion based on which, the students of class 12 board will be evaluated this year.
