The Union of India on Thursday raised objection to the Supreme Court giving priority hearing to the money bill matter, saying that matters should not be prioritised based on political exigencies.
The Bench of Chief Justice of India DY Chandrachud, Justice Sanjay Kishan Kaul, Justice Sanjiv Khanna, Justice BR Gavai, Justice Surya Kant, Justice JB Pardiwala and Justice Manoj Misra was passing directions for pre-hearing steps in various matters listed before seven -judge bench and nine-judge bench.
Talking about the pre-hearing steps the CJI said the Apex Court would pass a common order in all these matters in terms of the circular of August 22, 2023.
He added that the compilation of documents, pleadings and precedents, along with the written submissions, should be filed in three weeks.
One of the matters listed before the Bench for directions was Rojer Mathew vs South Indian Bank Ltd And Ors, pertainimg to money bills.
The matter was taken up on the insistence of Senior Advocate Kapil Sibal.
The top court of the country said it would give some priority to the matter.
Solicitor General (SG) Tushar Mehta objected to this by saying that the Apex Court should go by the seniority (of the cases).
He further said that priority of a matter could not be based on political exigencies.
The Rojer Mathew case was listed as the fifth matter chronologically out of the six cases listed before the seven-judge bench.
The Bench said that the SG should leave the matter with the Apex Court, which would take an appropriate call on the same.
