The Chief Justice of India (CJI) DY Chandrachud today said that he will take a call on listing the petitions which challenge the removal of special status granted to Jammu and Kashmir under Article 370 of the Indian Constitution.
The matter was mentioned by Senior Advocate Raju Ramachandran before a bench led by CJI DY Chandrachud.
CJI assured of taking a call on the same.
There are about 20 petitions which remain pending before the Apex Court which have challenged government’s decision for abrogating Article 370 of the Constitution, that resulted in the revocation of Jammu and Kashmir’s special status.
The state was eventually bifurcated into two Union Territories.
It was way back on March 2020, that a 5-judge Constitution bench of the Supreme Court had decided not to refer the batch of petitions to a 7-judge Constitution bench, even after some petitioners sought a reference.
The petitioners argued that the two Supreme Court judgments, which were rendered by 5-judge benches and dealt with the interpretation of Article 370, were in conflict.
However, the 5-judge bench that was hearing the case declined to refer the matter to a larger bench, stating that there was no conflict between the two judgments.
