The Supreme Court has adjourned till March 19, a petition filed by Bharat Rashtra Samithi (BRS) leader K. Kavitha against the summons issued to her by the Enforcement Directorate in connection with the Delhi liquor policy scam case.
The order was passed by the Bench of Justice Bela M Trivedi and Justice Pankaj Mithal on Friday on the grounds that the connected cases (raising the legal point whether a woman can be summoned by the Enforcement Directorate) were not listed for hearing on March 15.
The cases were listed last on March 13, but due to Justice Trivedi’s sitting in a Special Bench on the day, they could not be taken up.
Noting that one of the matters was not listed, the Apex Court listed the petition on March 19th along with all the matters.
During the course of hearing, Additional Solicitor General SV Raju, representing the national agency, sought to retract a statement made by him in September, 2023 to the effect that summons to the BRS leader would be deferred by 10 days.
The ASG contended that the statement he made earlier, giving 10 days notice on the summons, would not enure after this date.
However, the Bench showed it’s disinclination to indulge in the issue and posted the matter for March 19.
The petitioner’s side requested for the matter to be listed on March 20, but the Apex Court listed it for March 19, stating that it was a non-miscellaneous day.
When the petitioner’s counsel persisted for March 20, the top court of the country said that it would vacate the interim relief.
To this, the ASG claimed that he would beseech for a hearing on today itself, adding that there was no interim relief.
The national agency arrested the BRS leader and daughter of former Chief Minister K. Chandrashekhar Rao last evening in connection with the Delhi Excise Policy scam case.
