Supreme Court dismisses PIL seeking to quash FIRs on use of Diwali firecrackers

The division bench of Justices M.R. Shah and B.V. Nagarathna observed that the PIL under Article 32 petition is not maintainable to quash FIR.

The Supreme Court on Friday dismissed a Public Interest Litigation (PIL) seeking to quash FIRs registered over the use of firecrackers during Diwali.

The PIL has been filed by Sanjeev Newar and Swati Goel through Advocate Manju Jetley.

Advocate Shashank Shekhar Jha for the petitioner alleged that multiple FIRs were filed in different states.

He submitted that the Apex Court has clarified that there is no blanket ban on firecrackers, but FIRs are registered for even using green crackers.

The Division Bench of Justices M.R. Shah and B.V. Nagarathna observed that the PIL under Article 32 petition is not maintainable to quash FIR.

Accused can take appropriate legal remedies, the Court said while dismissing the PIL.

The PIL filed in November last year seeks a direction for no FIRs to be filed against general public if they burst crackers for lack of knowledge on ingredients of firecrackers.
