Supreme Court issues notice to Jharkhand govt over contempt plea filed by rape victim

The two-judge bench comprising Justice D.Y. Chandrachud and Justice M.R. Shah ordered that Standing Counsel of the state, Advocate Tapesh Kumar Singh, will file an affidavit in the court after taking instruction from the State of Jharkhand.

ILNS: Coming down heavily on the state of Jharkhand for not implementing its last year’s directions, the Supreme Court has issued notice to the Standing Counsel of State of Jharkhand, to file an affidavit, as to what steps it has taken in a contempt plea filed by a rape victim.

The two-judge bench comprising Justice D.Y. Chandrachud and Justice M.R. Shah ordered that Standing Counsel of the state, Advocate Tapesh Kumar Singh, will file an affidavit in the court after taking instruction from the State of Jharkhand, as to what steps have been taken to ensure the implementation of order dated November 29, 2020.

The rape victim appeared in person before the top court and complained that government officials were not obliging and following the order of the court vis-a-vis they were not providing her house and also not providing free education to her children.

On November 29, 2020, the apex court had passed the following order:-
(1) The Deputy Commissioner, Ranchi is directed to take measure to ensure that minor children of the petitioner are provided free education in any of the Government Institutions in District Ranchi, where the petitioner is residing, till they attain the age of 14 years.
(2) The Deputy Commissioner, Ranchi may also consider the case of the petitioner for providing house under the Prime Minister Awas Yojna or any other Central or State Scheme, in which the petitioner could be provided accommodation.

(3) The Senior Superintendent of Police, Ranchi and other competent authority shall review the Police security provided to the petitioner from time to time and take such measures as deem fit and proper.
(4) The District Legal Services Authority, Ranchi on representation made by the petitioner shall render legal services to the petitioner, as may be deemed fit to safeguard the interest of the petitioner.

The matter will be next taken up for hearing in the second week of July.
