A PIL has been filed in the Supreme Court challenging the inaction of the Delhi Government in failing to protect the spread of COVID-19 in Delhi which led to spread of the virus in the entire country.
The petition has been filed by Advocate Supriya Parihar through Advocate on Record Om Prakash Parihar and Advocate Dushyant Tiwari seeking directions to the Central Bureau of Investigation to investigate the matter related to the assembly of people at Anand Vhar Bus Terminal and Markaz as the Police had failed to control the people and the Nizamuddin Markaz Chief Maulana Saad has not been arrested till now.
The petitioner has highlighted that on 28.03.2020 a large number of migrant workers from Bihar and Uttar Pradesh who were working in Delhi has assembled at Anand Vihar Bus Terminal, Delhi to board the first available bus that would take them to their village, however these workers were not stopped by the Delhi Police and no action was taken by the Delhi Government and the Delhi Transport Corporation in order to stop these workers from coming out of their homes.
The petitioner has further pointed out that the Delhi Government and the DTC had further arranged DTC buses to drop the migrant workers at Anand Vihar Bus Terminal despite knowing that the movement of buses and people were restricted by the Delhi Government’s notification itself.
The petitioner has also highlighted the religious congregation at Markaz in Nizamuddin where 24 people were tested positive for COVID-19 who had attended the event between 15.03.2020 and 17.03.2020. the petitioner has submitted that all rules of social distancing were violated where around 2000 delegates from Malaysia, Indonesia, Saudi Arabia and Krygzstan had attended the congregation of Tablighi Jamat.
Moreover the Delhi Police had failed to arrest the Nizammudin markaz Chief maulana Saad, who had organized the event at the Markaz because of him thousands of people had gathered at nizamuddin leading to further spread of COVID-19 patients in India.
The petitioner has prayed that directions be issued for taking such measures to stop people from gathering at one place and to devise strategy to protect the fundamental Rights by the State.
